TERMS AND CONDITIONS OF USE (AGB)

Welcome to VietnamWork.com. Please read these Terms and Conditions ("AGB") carefully before using our services.

1. Scope & Service Provider

1.1. These Terms govern the use of the online recruitment platform available at https://vietnam-work.com/ (“Platform”).

1.2. The operator and legally responsible provider (“Provider”) is:

1.3. By accessing or registering an account, you (“User”) agree to comply with all terms herein. If you do not agree, please stop using the Platform.

2. Description of Services

2.1. VietnamWork is a technology platform that connects Employers and Job Seekers (including Freelancers).

2.2. We only provide technical infrastructure for posting and connecting. We are not an employment agency, nor do we participate in interviews or employment contract negotiations between parties.

2.3. At present, the basic services on the Platform are provided free of charge. We reserve the right to introduce paid service packages in the future. Any fees (if applicable) will be transparently communicated before payment.

3. Account Registration

3.1. You must have full legal capacity to register an account.

3.2. Information provided during registration must be truthful, accurate, and complete.

3.3. You are responsible for keeping your password secure. You must notify us immediately if you suspect unauthorized access to your account.

4. User Obligations & Uploaded Content

4.1. For Employers:

  •  Ensure that job postings are real and accurate.
  •  Do not request recruitment fees from applicants in any form.
  •  Comply with applicable labor laws and minimum wage regulations (if applicable).

4.2. Prohibited Content: It is strictly prohibited to upload content that:

  • Violates German, Vietnamese, or international law.
  •  Involves fraud, illegal multi-level schemes, or unclear “easy high-paying jobs.”
  •  Is discriminatory (race, gender, religion, etc.) under the German General Equal Treatment Act (AGG).
  •  Violates copyright or intellectual property rights.

4.3. Notice and Action Mechanism: If you detect violating content, you may report it to us via info@vietnam-work.com. We will review and reserve the right to remove the content or block violating accounts without prior notice.

5. Right of Withdrawal (Widerrufsrecht) – For EU Consumers

If you are a consumer residing in the European Union (EU), you have the right to withdraw from this service contract within 14 days without providing reasons.

  •  Period: 14 days from the date of account registration.
  •  Method: Send a notification via email to info@vietnam-work.com.
  •  Note: This right expires early if we have begun providing the service (e.g., your job posting has been displayed) with your explicit consent.

6. Limitation of Liability (Haftungsbeschränkung)

In accordance with German law, the liability of Hung IT Solutions is defined as follows:

6.1. We are fully liable for intent, gross negligence, and for damages to life, body, or health.

6.2. For slight negligence, we are only liable for breaches of essential contractual obligations (obligations required to achieve the purpose of the contract). In such cases, liability is limited to foreseeable damages.

6.3. We are not liable for the accuracy of job postings or applicant profiles submitted by users.

6.4. We do not guarantee uninterrupted operation of the Platform, as downtime may occur due to maintenance or technical issues.

7. Data Protection

The collection and processing of your personal data comply with our Privacy Policy (see link in the footer), in accordance with GDPR and applicable regulations.

8. Online Dispute Resolution (EU ODR)

In accordance with EU regulations, we provide the link to the European Commission’s Online Dispute Resolution platform:

ODR. We are neither obligated nor committed to participating in consumer arbitration proceedings.

9. Final Provisions

9.1. The applicable law is the law of the Federal Republic of Germany.

9.2. The place of jurisdiction is Munich, Germany, if the user is a merchant or public-law entity.

9.3. If any provision of these Terms is invalid, the remaining provisions remain fully effective.
